ACCEPTANCE OF RISK AGREEMENT AND RELEASE

Acknowledgement
By signing this document I acknowledge that:
● Activities and tours listed below conducted by Beyond the Classroom SA and related brand names and trusts (referred to in this document inclusively as “BTC”) involve some degree of physical risk and I accept the inherent risk.
● I am aware of the potential dangers associated with activities and tours listed below.
● I have read the terms and conditions in the Acceptance of Risk and Release Agreement and fully understand them.
● I have signed this document freely and voluntarily.

Full activities list includes: school camps, camping, team building activities and challenges, swimming and snorkelling, rock climbing, abseiling, outdoor laser tag, amazing race style activities (scavenger hunts), geocaching games, trivia quizzes, game show themed events, events using props, light games and activities, puzzles, foam javelin throwing, relay races, races, walking, blind fold trust exercises, bushwalking, canoeing/kayaking/paddling, sand boarding, mountain bike riding, raft building, pedal karts, paddle boats, educational activities and demonstrations, blacksmith show, butter making, mud brick making, rope making, archery, small farm animal feeding, bike tours and hire, surfboard and snorkel hire, booking desk, surf lessons, stand up paddleboard lessons, tours, tours in bus / transfers, boat tours, tours of
privately owned cave (Puneylroo), 4WD and mini bus tours, winery tours, seminars / workshops

ACCEPTANCE OF RISK AND RELEASE
Risk of Injury, Loss or Death
● I acknowledge all risks associated with the activities and tours listed above including the possibility of injury, trauma, loss, damage or death;
Medical or Other Conditions
● I acknowledge that the pre-existing medical or other conditions disclosed to BTC (in the separate medical form OR on this form) are the only
conditions that may affect my ability to participate in the activities or increase the risk of injury, trauma, loss, damage or death to myself or
some other person and that BTC has relied on this information.
Obey Rules and Directions
● I agree to obey and comply with all rules and directions made or given by BTC in connection with the activities and tours listed above for my safety and the safety of others;
● I acknowledge and accept that if I do not comply with the rules and/or directions I will not be permitted to commence or continue with the activities and I will not be entitled to a refund of any monies paid by me to BTC;
● I acknowledge that BTC reserves the right to refuse permission for any person to undertake any activity where, in the opinion of BTC, any safety standards could be compromised. The decision of BTC on these matters is final and no refund applies.
Report Injuries etc
● I agree to report to BTC all accidents, injuries, loss or damage suffered by me or caused by me in relation to the activities.
Evacuation / Ambulance etc
● If I suffer any injury or illness I consent to BTC providing/organising such rescue, evacuation, ambulance attendance, first aid and medical treatment as BTC considers necessary and at my expense. I give permission for BTC staff and consultants to perform First Aid and administer medication as instructed if required and I am unable to do so myself, and/or obtain any necessary medical assistance for myself should any medical problem or accident occur. I give permission for BTC staff or consultants to provide me with a Ventolin if required in an emergency by a trained Asthma first aid person.

FORM 1 | Recreational Services | Exclusion, restriction or modification of rights under Australian Consumer Law(SA)

Your rights: Under sections 60 and 61 of the Australian Consumer Law (SA), if a person in trade or commerce supplies you with services (including recreational services 1, there is - a statutory guarantee that those services will be rendered with due care and skill; and a statutory guarantee that those services, and any product resulting from those services, will be reasonably fit for the purpose for which the services are being acquired (as long as that purpose is made known to the supplier); and a statutory guarantee that those services, and any product resulting from those services, will be of such a
nature, and quality, state or condition, that they might reasonably be expected to achieve the result that the consumer wishes to achieve (as long as that wish is made known to the supplier or a person with whom negotiations have been conducted in relation to the acquisition of the services).

Excluding, restricting or modifying your rights: Under section 42 of the Fair Trading Act 1987, the supplier of recreational services is entitled to ask you to agree to exclude, restrict or modify his or her liability for any personal injury suffered by you or another person for whom or on whose behalf you are acquiring the services (a third party consumer). If you sign this form, you will be agreeing to exclude, restrict or modify the supplier's liability with the result that compensation may not be payable if you or the third party consumer suffer personal injury. 2

Important: You do not have to agree to exclude, restrict or modify your rights by signing this form. The supplier may refuse to provide you with the services if you do not agree to exclude, restrict or modify your rights by signing this form. Even if you sign this form, you may still have further legal rights against the supplier. A child under the age of 18 cannot legally agree to exclude, restrict or modify his or her rights. A parent or guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.

Agreement to exclude, restrict or modify your rights:
I agree that the liability of Beyond the Classroom SA and related brand names and trusts for any personal injury that may result from the supply of the
recreational services that may be suffered by me (or a person for whom or on whose behalf I am acquiring the services) is excluded save where personal injury, loss or damage is caused or contributed to by the negligence, breach of contract, breach of a statutory duty or other duty by the supplier of recreational services including its servants, agents and contractors.

Definitions
1 Recreational services are services that consist of participation in a sporting activity or similar leisure - time pursuit; or any other activity that involves a significant degree of physical
exertion or risk and is undertaken for the purposes of recreation, enjoyment or leisure.
2Personal injury is bodily injury and includes mental and nervous shock and death.
